The Planning Commission of the City of Hercules will hold a public hearing and consider taking action on the following—SAFEWAY CENTER PROJECT: General Plan Amendment #17-01, Zoning Amendment (RZ) #17-01, Zoning Text Amendment #17-01, Initial/Final Planned Development Plan #17-01, Design Review Permit #17-02, Conditional Use Permit #17-01, Minor Exception #17-01, and California Environmental Quality Act (CEQA) Initial Study #17-01 and Addendum. The project includes construction of approximately 65,600 square feet of general commercial space on approximately 6.75 acres of land.

DESCRIPTION: The Safeway Center project is a proposed locally-serving shopping center of approximately 65,600 square feet and will consist of three (3) separate structures, including a fuel center. The project site consists of one parcel totaling approximately 6.75 acres. The northern portion of the project site is planned for an approximately 57,100-square-foot grocery supermarket with an attached interior Starbucks coffee shop and an exterior seating area. The project scope also includes a 6,000-square-foot commercial building with the potential for two (2) drive-thru-based uses (one of which is intended for a Chase commercial bank) which will be located within the central portion of the site, and a 2,500-square-foot fueling center and convenience store/minimart which will be located within the southern frontage of the subject 6.75-acre parcel. A Conditional Use Permit will be required for the two (2) drive-thrus, a 20-pump fuel center with related convenience kiosk, 24-hour operation grocery store with liquor sales and drug store, outdoor sales, and retail uses greater than 2,000 square feet (included in the above building square footage). The proposed project will amend the General Plan Land Use from New Town Center (NTC) to General Commercial (CG) and related Zoning from NTC to CG, and will require each future project proposal in the NTC Planning Area to be evaluated under CEQA criteria for potential transportation and traffic impacts to help ensure that overall trip generation and traffic operations will remain below the levels that were evaluated in the Hercules New Town Center Environmental Impact Report (SCH #2007062002) and Addendums thereto. The project will also require approval of an Initial/Final Planned Development Plan (the Initial and Final Planned Development Plans approved for the project site in 2009 have expired). The applicant requests Minor Exceptions (ME 17-01) to allow (a) a maximum building height of 39 feet, which is 4 feet above the standard height limit of 35 feet, and (b) a 10% reduction in the minimum parking requirement from 262 to 236 spaces. The applicant also requests to amend Section 34.400.H “Signs Subject to Review” of the Hercules Zoning Ordinance to allow for the installation of a new 85-foot tall freestanding, freeway-oriented pylon sign in CG Districts adjacent to Highway 80.
ENVIRONMENTAL REVIEW: The City has prepared an Addendum to the Hercules New Town Center Environmental Impact Report (SCH #2007062002) certified by the City Council on February 10, 2009 (the 2009 EIR), pursuant to Sections 15164 and 15168(d)(1) of the CEQA Guidelines, based on its determination that the land uses analyzed and impacts resulting from the level of development for the proposed Safeway Center project are within the scope of the development program evaluated in the 2009 EIR, and the Planning Commission will consider adoption of the Addendum at this meeting. The 2009 EIR includes mitigation measures that will be applicable as appropriate to the proposed Safeway Center project.
PUBLIC HEARING: At a properly noticed public hearing to be held on Tuesday, September 5, 2017, at 7:00 p.m., the Planning Commission will consider whether the proposed Project and environmental analysis and Addendum comply with CEQA and the intent of the Hercules General Plan and Zoning Ordinance (as designed and conditioned), and upon conclusion of the public hearing, will make a recommending motion to the City of Hercules City Council (for its consideration at a subsequent public hearing scheduled for September 26, 2017). The public hearing will be held before the City Planning Commission in the City Council Chambers located at 111 Civic Center Drive, Hercules, for the initial review and recommended motion on the overall Project.
